myHealthPointe PRIVACY NOTICE

Netsmart Technologies, Inc. (“Netsmart”, “we”, “us”, or “our”) respects your privacy and is committed to protecting it through our compliance with this privacy notice (“Privacy Notice”). This Privacy Notice identifies the types of Personal Information we may obtain from or about you, and our practices for collecting, using, maintaining, protecting, and disclosing that Personal Information for the purpose of providing myHealthPointe to our Clients.
This Privacy Notice applies to the myHealthPointe solution and the services made available through it, including related software, mobile applications, websites, electronic healthcare record systems, and other support platforms (collectively, “MHP” or the “Application”). The Application may be publicly available for download on public app stores; however, downloading the Application does not grant access to or enable use of MHP. To access and use the Application, you must be an authorized user, such as a patient or caregiver, whose access is provisioned or supported by a participating agency, organization, provider, or other entity that contracts with Netsmart for MHP (collectively “Client”).
This Privacy Notice applies to the personal information accessed, collected, used, and processed on behalf of Clients who contract with Netsmart for MHP. This Privacy Notice also applies to patients, agency personnel, administrators, caregivers, and other authorized users who access or use MHP through a Client.
For information made available through MHP by your healthcare provider or organization, Netsmart processes the information on behalf of that provider or organization and in accordance with our contractual obligations with our Client. Your healthcare provider or organization remains responsible for determining and disclosing to you how your health information is used and disclosed for treatment, payment, healthcare operations, and other purposes permitted by law.
MHP may be used by patients or by authorized caregivers, parents, guardians, or personal representatives, depending on access granted by the Client. We process information associated with minors only as directed or authorized by the applicable Client and in accordance with applicable law.
Clients, its affiliates and subsidiaries may have separate websites, subdomains, applications, or services through other web, mobile, or cloud-based platforms which are not subject to this Privacy Notice. We encourage you to read the privacy notices of all websites and applications that you visit and understand their privacy practices.
Personal Information means any information and data that identifies, relates to, describes, is reasonably capable of being associated with, or could be reasonably linked, directly or indirectly, with a particular consumer or device in a household (“Personal Information”). Personal Information does not include publicly available information or information that is de-identified or aggregated consumer information. Upon your request or with your consent, a Client may share Personal Information about you with Netsmart to provision and maintain your access to and use of MHP. When you use MHP, we may collect additional Personal Information about you to provide MHP and to improve your user experience with the Application.

If payment functionality is available through your provider, MHP may allow you to submit payment information through an integrated third-party payment processor, such as CardConnect. Full payment card information is processed by the payment processor and is not stored by Netsmart. Netsmart may receive and retain limited transaction information, such as transaction ID, card type, payment amount, payment status, and date of transaction, for payment confirmation, reconciliation, recordkeeping, fraud prevention, and support purposes.

With regards to Personal Information shared by your healthcare provider, Netsmart will only use such information in accordance with the terms of our services agreement with each Client.
We do not sell or share your Personal Information to third parties. We do not sell or share your Personal Information with third parties for their promotional or marketing purposes. We may disclose Personal Information that we collect, as described in this Privacy Notice, with third parties who support our business (i.e., contractors, service providers, business partners, etc.) to:
We have implemented measures designed to secure your Personal Information from accidental loss and from unauthorized access, use, alteration, and disclosure. We use physical, electronic and administrative safeguards to protect your Personal Information. The safety and security of your Personal Information also depends on you. Where we have given you (or where you have chosen or have been given a password by a Client) a password for access to MHP, you are responsible for keeping this password confidential. We ask you not to share your password with anyone.
Netsmart develops and hosts MHP but processes information solely on behalf of Clients. Clients serve as the data controllers and determine how Personal Information is collected, used, retained, and deleted. Personal Information processed through MHP is retained in accordance with the applicable Client’s retention policies, contractual requirements, and legal obligations. As a result, retention periods may vary depending on the Client and the type of information involved. Users who wish to request access to, correction of, or deletion of their Personal Information should contact the Client that provided them access to MHP. Netsmart does not, and cannot, independently determine whether Personal Information should be deleted. Upon receipt of a valid instruction from the applicable Client, Netsmart will delete or return Personal Information in accordance with its contractual obligations and applicable law.
As a service provider, Netsmart processes Personal Information on behalf of its Clients and does not control its Clients’ privacy or data security practices. Accordingly, individuals seeking to exercise their privacy rights should submit their requests directly to the Client currently provisioning or supporting their MHP access. Netsmart will assist its Clients in responding to such requests as required by applicable law and its contractual obligations.
We reserve the right to amend this Privacy Notice at our discretion and at any time. When we make changes to this Privacy Notice, we will post the updated Privacy Notice on the MyHealthPointe application website and update the policy’s “Last Modified” date. You are responsible for regularly reviewing the terms of the Privacy Notice to stay informed of changes or modifications of the Privacy Notice.
